COUNTRY OR CONSTITUTION?
NB: Country is Bharat. Constitution is “Sarkar”!
Normally they are in synchronised harmony as in the United Kingdom and the United States. In short:
WILL OF THE (ENLIGHTENED & FREE) PEOPLE IS THE WILL OF THE GOVERNMENT. AND THE WILL OF SUCH GOVERNMENT IS THE CONSTITUTION.
For example, today a Hindu nationalist and a foremost patriot Shri Narendra Modi is the Prime Minister as per Constitution, and his loyalty to COUNTRY and its PEOPLE is beyond doubt.
Could someone like Mohammed Ali Jinnah come up to Mr Modi and demand Partition? HE WILL BE IN HANDCUFFS IN NO TIME!
Yet in 1940 (till 1947) Mr Jinnah stood tall & defiant for PARTITION, having sensed Power VACUUM created by appeasing pacifist Mr MK Gandhi. He threatened “rivers of blood” and “civil war” if ignored or refused. Neither “stalwart” Gandhi nor Barrister Nehru missed a wink during sleep! They both enjoyed baby’s sound sleep every night till August 1947 when they suddenly woke up. Water had gone over their heads. The country was doomed!
After the bloody Partition, one became the inspiration and the “guiding light” of “Broken” Bharat, the other the "Government of India"!
Now the question arises, “Did they, especially Nehru, since Gandhi was eliminated soon afterwards by a patriot, have the moral or Constitutional right, or authority, to order the army to vacate their forts and fortresses across the Western frontier and withdraw down to Wagah/Atari in the middle of our Punjab, and similar despicable treatment meted to to Bengal? India’s two grand provinces, each the size of France or Germany, lay bisected, and left bleeding with the Hindus being ethnically cleansed.
The question is, “Who commanded the ULTIMATE loyalty of the Indian Armed Forces? Our eternal COUNTRY (INDIA) OR the transient GOVERNMENT of Nehru, or Nehru himself that was "here today and gone tomorrow"?
Thereafter, in January 1948, did Nehru, the anglicised “Brown Sahib”, an alien among the natives (mostly Hindus), have the authority, moral as well as constitutional, to stop our ADVANCING Army from recovering North Kashmir from the enemy, and declare “cease-fire”?
I submit he had as much right and authority to order the Army to withdraw as did Emperors Babur and Aurangzeb or Tipu Sultan, the “Constitutional” heads of Hindusthan at the time. An ALIEN imposed on top cannot have any right of the kind!
Hence the post-Partition Government of “mutilated” Bharat (India) was ILLEGAL. Only Referendum could grant it the legitimacy and the authority of the People! Referendum never took place. Hence the borders of Bharat (since 1947) are illegitimate and unacceptable!
There could be NO “proper” government of India if there was NO "proper" India that now extends from Wagah to Hoogly, MINUS Khyber Pass and Chittagong!
The present day Bharat has eternal LEGAL claim over that (pre Partition) India, and the claim is not time barred! Why is Bharat collapsed, or reconciled, ready to remain a mere FRAGMENT of the ORIGINAL?
Constitutional scholars may ponder over this, and issue guidelines for the FUTURE of Hindusthan to the present “SARKAR”.
Thinking with a logical head, we discover that Bharat has NO legitimacy as a country. It was recreated by bullies and fraudsters, not by its PEOPLE through Referendum.
